Welcome to Koala Nest.
These Terms of Use (“Terms”) govern your access to and use of the websites, mobile applications, content, features, and related services provided by Koala Nest LLC (“Koala Nest,” “we,” “us,” or “our”).
By downloading, accessing, or using any Koala Nest application, website, or service, you agree to these Terms. If you do not agree, do not use our applications, websites, or services.
1. About Koala Nest
Koala Nest LLC builds simple, thoughtful mobile applications designed to support families and everyday routines. Our current applications include family-focused tools that are designed to be useful, respectful of user privacy, and easy to use.
2. Family Use and Parent/Guardian Responsibility
Koala Nest apps may be used by children with the involvement, permission, and supervision of a parent or legal guardian.
If you allow a child to use a Koala Nest app, you are responsible for deciding whether the app is appropriate, supervising use where appropriate, managing device and iCloud settings, reviewing App Store downloads or purchases, and ensuring that the child uses the app safely and appropriately.
By allowing a child to use a Koala Nest app, you confirm that you are the child’s parent or legal guardian, or that you have authority to permit the child’s use.
3. Caregiver Coordination Apps
Some Koala Nest apps may be designed for caregivers and families coordinating routines and observations related to health-related care.
A caregiver coordination app is not intended for unsupervised child use. A parent, guardian, or caregiver should manage app setup, review app information, and decide how the app fits into the child’s care routine.
4. No Medical Advice or Treatment
Caregiver coordination apps are tracking and coordination tools. They are not medical devices and do not provide medical advice, diagnosis, treatment, therapy, clinical decision support, or emergency care.
Koala Nest apps are not intended to replace a pediatrician, gastroenterologist, therapist, school nurse, or other qualified professional.
Caregivers should follow the care plan provided by the child’s healthcare professionals. Do not use a Koala Nest app to make or change medical decisions, including decisions about medication, laxatives, diet, toileting routines, behavioral plans, school accommodations, or treatment timing, without consulting a qualified healthcare professional.
If a child has severe pain, blood in stool, vomiting, fever, dehydration, sudden worsening symptoms, or any urgent concern, seek medical care immediately.
5. Our Design Principles
We design apps to help, not distract. That means no clickbait, no intrusive ads, no designs meant to confuse or pressure kids, no focus on in-app purchases as the core experience, and simple tools designed for real life.
We may offer paid apps, subscriptions, or paid features in the future. Any paid feature will be clearly disclosed before purchase and processed through the applicable app marketplace, such as Apple’s App Store.
6. License to Use Our Apps
Subject to these Terms, Koala Nest grants you a limited, personal, non-exclusive, non-transferable, revocable license to download and use our apps for personal, non-commercial use on devices you own or control.
You may not copy, modify, distribute, sell, rent, lease, sublicense, commercially exploit, reverse engineer, decompile, disassemble, or attempt to extract source code from our apps, except where such restriction is prohibited by law.
You may not interfere with the operation, security, or integrity of our apps or website, use our apps or website for unlawful or harmful purposes, or misuse our contact forms, support channels, or website.
7. Apple App Store Terms
If you download a Koala Nest app through Apple’s App Store, your use of the app may also be subject to Apple’s applicable terms, including Apple’s App Store rules, Apple Media Services Terms and Conditions, Apple ID terms, iCloud terms, Family Sharing settings, Screen Time settings, and any applicable Apple standard licensed application terms.
Apple is not responsible for providing support for Koala Nest apps. Support requests should be submitted through our Contact page.
8. App-Specific Storage and Future Server-Based Services
Koala Nest apps may use different storage systems depending on the features of each app.
Our current apps are designed so app data is stored on the user’s device and, when enabled, in the user’s Apple iCloud account. Koala Nest does not operate its own servers to store current app data.
Future Koala Nest apps may use Koala Nest-operated servers or third-party service providers to provide features such as accounts, secure sync, family collaboration, backups, support, or other app functionality. If a future app uses server-based storage or processing, the applicable app disclosures will describe those practices.
Some future features may require a user account, internet access, server availability, additional privacy disclosures, or separate app-specific terms. If account creation is offered, account deletion options will be provided as required by applicable App Store requirements and applicable law.
9. App Data, Device Storage, and iCloud
Koala Nest’s current apps are designed so app data is stored on your device and, when enabled, in your Apple iCloud account. Koala Nest does not operate its own servers to store current app data.
Some app data may be stored locally in the app’s sandboxed Core Data store and, when iCloud is enabled, synced through Apple CloudKit to the user’s private iCloud database. Some apps may also use Apple CloudKit sharing features where a user chooses to share records with other iCloud users.
Koala Nest does not receive, view, or manage app data stored on your device or in your iCloud account.
You are responsible for managing your device, Apple ID, iCloud account, iCloud sync settings, iCloud storage availability, device backups, app deletion, and app data deletion.
Koala Nest is not responsible for loss of app data caused by device failure, app deletion, iCloud settings, insufficient iCloud storage, Apple service issues, operating system changes, user error, or other events outside Koala Nest’s control.
10. User-Initiated Sharing and Exports
Some Koala Nest apps may allow users to export reports, CSV files, PDFs, summaries, or other app information using Apple’s system share sheet or similar user-controlled sharing tools.
When you choose to export or share information, you are responsible for selecting the destination and deciding who receives the information. Once you share information outside the app, the recipient service, app, person, or device may handle that information according to its own terms and privacy practices.
11. Purchases and Payments
If we offer paid apps, subscriptions, or in-app purchases, purchases will be handled by the applicable app marketplace, such as Apple’s App Store.
Refunds, billing issues, purchase history, subscription management, and payment methods are generally handled by the applicable marketplace according to its policies.
We do not design our apps around pressure to spend. Any paid feature should be clearly disclosed before purchase.
12. Intellectual Property
The apps, website, names, logos, designs, graphics, text, software, features, content, and other materials provided by Koala Nest are owned by Koala Nest LLC or its licensors and are protected by intellectual property laws.
You may not use Koala Nest names, logos, branding, screenshots, app content, or other materials without our prior written permission, except as allowed by law.
13. Feedback and Suggestions
If you submit ideas, suggestions, comments, or feedback to Koala Nest, you allow us to use them without restriction or compensation to you. We appreciate feedback, but we cannot promise that we will implement any suggestion.
14. Availability and Updates
We may update, modify, suspend, or discontinue any app, feature, website, or service at any time. Some features may require a compatible device, operating system, Apple ID, iCloud account, internet connection, or updated app version.
15. Prohibited Uses
You agree not to use our apps or website for unlawful purposes, disrupt or interfere with our apps or systems, submit false or harmful content through our forms, impersonate another person, violate third-party rights, or attempt to bypass security features.
16. Disclaimer of Warranties
To the fullest extent permitted by law, Koala Nest apps, websites, and services are provided “as is” and “as available.” We do not guarantee that our apps, websites, or services will be uninterrupted, error-free, secure, compatible with every device, or free from data loss.
Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
17. Limitation of Liability
To the fullest extent permitted by law, Koala Nest LLC and its owners, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, loss of profits, loss of goodwill, device issues, service interruptions, or inability to use our apps or website.
To the fullest extent permitted by law, Koala Nest LLC’s total liability for any claim relating to our apps, website, or services will not exceed the amount you paid directly for the app or service giving rise to the claim during the twelve months before the claim arose, or $100, whichever is greater.
18. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Koala Nest LLC from claims, damages, liabilities, losses, and expenses arising from your misuse of our apps or website, violation of these Terms, violation of law, or violation of third-party rights.
19. Termination
We may suspend or terminate access to our apps, website, or services if we believe you violated these Terms or used our services in a harmful, unlawful, abusive, or deceptive way. You may stop using our apps at any time and may delete them from your device.
20. Governing Law
These Terms are governed by the laws of the State of North Carolina, United States, without regard to conflict of law principles, except where applicable consumer protection laws require otherwise.
21. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the “Last Updated” date above. Your continued use of our apps, websites, or services after changes become effective means you accept the updated Terms.
